Alternative Dispute Resolution

We hereby inform you that, as a consumer, you have the option to contact a local ADR entity for the resolution of a dispute that you have not been able to resolve directly with EXTREME GEAR S.R.L.
What is ADR?
To avoid costly and lengthy judicial procedures, according to the law, ADR is a procedure for out-of-court resolution of national and cross-border disputes regarding contractual obligations resulting from sales or service contracts between a trader established in the European Union and a consumer, through the intervention of an ADR entity that proposes or imposes a solution or brings the parties together with the aim of facilitating an amicable solution.
ADR entities are extrajudicial entities. An ADR entity is a neutral party (e.g., a conciliator, mediator, arbitrator, ombudsman, or an appeals board) that EXTREME GEAR S.R.L. will use to resolve disputes if the consumer decides to use the ADR mechanism. The ADR process involves low costs, a simple and fast procedure, being therefore beneficial for both consumers and traders, who can avoid judicial costs and lengthy processes.
How do I file a complaint through the ADR process? If you wish to file a complaint, please contact the national ADR entity below. This ADR entity will be able to answer any questions you may have about the process.

The Alternative Dispute Resolution Directorate within the National Authority for Consumer Protection has the competence to alternatively resolve national and cross-border disputes arising from sales contracts or service contracts concluded with a trader operating in Romania, in the activity sectors where ANPC is competent.

How is the dispute resolved?
For the purpose of resolving the dispute, the ADR Directorate implements a mechanism for proposing a solution to the parties, according to which, if only one of the parties accepts the proposed solution, the outcome of the procedure is not binding. If the trader does not accept the proposed solution, the ADR Directorate informs the consumer, by conclusion, about the administrative and judicial remedies they can resort to for resolving the dispute.
What are the conditions for accessing the ADR procedure?
- The dispute could not be resolved directly with the trader;
- The complaint has not been previously analyzed by another ADR entity or by a court of law, nor submitted to another public authority;
- The complaint is filed within 1 year from the date it was presented to the trader or from the date of the act that gave rise to the dispute;
- The handling of the dispute does not seriously affect the efficient operation of the ADR entity;
- The dispute is not filed in bad faith and is not offensive;
- The dispute falls within the competence of the notified ADR entity.
Online Dispute Resolution
To resolve disputes that may arise between consumers and traders in the EU or in Norway, Iceland, and Liechtenstein, related to products and services purchased online, the European Commission has provided an online platform for their resolution, without resorting to court proceedings.
The ODR platform is not associated with any trader. You can use it to bring your complaint before an authorized dispute resolution entity.
Dispute resolution entities are impartial organizations or individuals who help consumers and traders reach an agreement out of court. Typically, such a procedure is faster and cheaper than a judicial one.
The ODR platform is easy to use, guiding users step-by-step. It provides translations into all official EU languages and sets deadlines for resolving complaints.
Thanks to the ODR platform, consumers can obtain fair solutions either free of charge or at very low cost, and traders can avoid costly judicial procedures and maintain good customer relations.
The Online Dispute Resolution (ODR) platform provides consumers and traders with a way to resolve disputes related to online purchases both from their own country and from abroad. Specifically, disputes are submitted to alternative dispute resolution bodies (ADR entities) registered on the platform. These are selected by member states according to certain quality criteria and then communicated to the Commission.
